In this case, the Supreme Court considered whether police officers waive their immunity under the Colorado Governmental Immunity Act (CGIA) by failing to use their emergency lights or siren at any point during a high-speed pursuit that ends in an accident. The Court held that an emergency driver waives CGIA immunity when a plaintiff’s injuries could have resulted from the driver’s failure to use alerts while speeding in pursuit of a suspected or actual lawbreaker.
