In this attorney discipline case, the supreme court considered whether the Presiding Disciplinary Judge (PDJ) should have disqualified himself from former elected District Attorney Linda Stanley’s attorney discipline proceeding. The court also reviewed the hearing board’s (board) finding that Stanley violated Colo. RPC 5.1(b) and Colo. RPC 8.4(a) and (d) and the sanction imposed by the board.
The court held that the PDJ was not required to disqualify himself from the entirety of Stanley’s proceedings. The court reversed the board’s finding that Stanley violated Colo. RPC 5.1(b); affirmed the board’s findings that she violated Colo. RPC 8.4(a) and (d); and concluded that the sanction of disbarment was proper.
