In the Matter of the Title, Ballot Title, and Submission Clause for Proposed Initiative 2023–2024 #175.

2024 CO 52. No. 24SA117. CRS § 1-40-107(2)—Statutory Jurisdiction—Ballot Title Board.

June 24, 2024

This case concerns the appropriate timeline for appeal of Title Board rulings pursuant to CRS § 1-40-107(2). The Supreme Court reaffirmed its prior holding in In re Title, Ballot Title & Submission Clause & Summary for 1997–98 #62, 961 P.2d 1077, 1079 (Colo. 1998), and found that parties seeking review under § 1-40-107(2) must file their petition within seven days of the allegedly erroneous Title Board decision. Because the petitioner filed more than seven days after the underlying Title Board decision, the Court lacked jurisdiction to consider this case and dismissed the appeal.
