The Presiding Disciplinary Judge approved the parties’ stipulation to discipline and suspended James William Bain (attorney registration number 15506) for six months, with the requirement of resignation under CRCP 242.20 and 227(A)(8). The suspension was effective on April 2, 2026.
Bain, who is 76 years old, has been retired from the practice of law since December 2021, when he changed his licensure status to “inactive status.” Bain believed that he had resigned his law license at that time.
On June 10, 2024, Bain pleaded guilty in Arapahoe County to two counts of third degree assault. Elements of this crime include unlawfully, and knowing or recklessly, causing bodily injury to another. The same day, Bain was sentenced to 18 months of supervised probation, with terms and conditions. He completed his probationary sentence on November 18, 2025.
Bain did not report his conviction, as he was required to do under CRCP 242.11.
Through the conduct described above, Bain violated Colo. RPC 3.4(c) (a lawyer must not knowingly disobey an obligation under the rules of a tribunal) and Colo. RPC 8.4(b) (it is professional misconduct for a lawyer to commit a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects).
