The supreme court held that the district court erred in granting Chapman’s Motion for Appointment of Special Prosecutor pursuant to CRS § 20-1-107(2). Because Chapman failed to present evidence of special circumstances that would justify disqualification of the entire Eighth Judicial District Attorney’s Office, the court reversed the district court’s order.
