In this C.A.R. 4.1 appeal, the supreme court reversed the district court’s order suppressing evidence seized in Havens’s motel room because the district court misinterpreted the body-worn camera statute, CRS § 24-31-902, and Crim. P. 16. The court remanded the case to the district court to hold a hearing to give the prosecution the opportunity to rebut the presumption of inadmissibility set forth in § 24-31-902(1)(a)(III).
