The supreme court held that an appeal from an order dismissing all criminal counts against a defendant on as-applied constitutional grounds must be filed in the court of appeals under CRS § 16-12-102(1) and C.A.R. 4(b)(6)(A). Because this appeal was erroneously filed in the supreme court, it must be transferred to the court of appeals under CRS § 13-4-110(2) and (3).
