People v. McConkie.

No. 25PDJ36. 8/7/2025. Stipulation to Discipline.

The Presiding Disciplinary Judge approved the parties’ stipulation to discipline and suspended David George McConkie (attorney registration number 39864) for three years. To be reinstated to the practice of law, McConkie must prove by clear and convincing evidence that he has been rehabilitated, has complied with all disciplinary orders and rules, and is fit to practice law. McConkie’s suspension took effect on August 7, 2025.

On April 4, 2025, McConkie signed a plea agreement and pleaded guilty to the charge of criminal attempt to commit sexual assault on a child, a class 5 felony. Respondent, who was a deputy district attorney in the Fourth Judicial District from 2008 to 2011, was sentenced to five years of supervised sex offender intensive probation with conditions and the possibility of early termination.

Through this misconduct, McConkie violated Colo. RPC 8.4(b) (it is professional misconduct for a lawyer to commit a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects).
