In this appeal, the Supreme Court reviewed a district court order invalidating part of Colorado’s harassment statute. The district court concluded that the phrase “intended to harass” in CRS § 18-9-111(1)(e) unconstitutionally restricts protected speech. The Court agreed that this provision is substantially overbroad on its face and thus affirmed the district court’s order.
