People v. Nelson.

The Presiding Disciplinary Judge entered default and imposed reciprocal discipline, disbarring Danial Alan Nelson (attorney registration number 33016). Nelson’s disbarment took effect on April 27, 2023.

On October 25, 2016, the Supreme Court, Appellate Division, First Department, New York, issued an opinion in which it disbarred Nelson from the practice of law in New York, nunc pro tunc to February 26, 2016. The discipline was premised on Nelson’s conviction in New York of sexual abuse in the first degree, a class D felony, and of criminal obstruction of breathing or blood circulation, a class A misdemeanor. Nelson did not notify Colorado disciplinary authorities about his New York disbarment.

Through this conduct, Nelson engaged in conduct constituting grounds for reciprocal discipline under CRCP 242.21, which calls for imposition of the same discipline as that imposed in New York.
