In this interlocutory appeal, the supreme court held that the district court erred when it suppressed statements made by Torres. The court concluded that (1) Torres did not clearly invoke his right to remain silent such that a reasonable officer under the circumstances would understand that he was asserting his right to cut off questioning pursuant to Miranda. v. Arizona, 384 U.S. 436, 439 (1966); (2) he voluntarily waived his right to remain silent based on the totality of the circumstances; and (3) his statements were voluntary. Accordingly, the court reversed the district court’s order suppressing Torres’s statements and remanded the case for further proceedings.
